The Supreme Court on Friday granted Delhi Chief Minister Arvind Kejriwal temporary bail until June 1 in the excise policy case, a move that could have a major impact on the current general elections and the political climate in Delhi. Underscoring that the particulars of the case and the surrounding circumstances required an all-encompassing approach, it continued, “Given the prodigious importance, we reject the argument raised on behalf of the prosecution (ED) that grant of interim bail/release on this account would be giving premium of placing the politicians in a benefic position compared to ordinary citizens of this country.”

Kejriwal’s release on bond prohibits him from going to the Delhi Secretariat or the Chief Minister’s office. In order to be released from Tihar jail, where he is now being held, he has been ordered to provide bail bonds of Rs 50,000 with one guarantee of the same amount. Judges Sanjiv Khanna and Dipankar Datta of the Supreme Court announced that Kejriwal must turn himself in and return to custody on June 2.

Senior attorney Abhishek Singhvi argued on behalf of Kejriwal, but the court rejected his request to extend the temporary bail till June 5. The seven-phase elections conclude on June 1; vote counting is set for June 4.

The bench noted that the ED’s Enforcement Case Information Report (ECIR) was registered in August 2022 while the chief minister was arrested on March 21 of this year, and that granting Kejriwal interim bail for 21 days would not significantly impact the situation.
